Los Angeles City Atty. Mike Feuer said the Lakeview Terrace nursing home has agreed to settle a lawsuit alleging it discharged patients in favor of other people suffering from COVID-19, which often cost more to treat.

A nursing home accused of illegally “dumping” patients on city streets and homes ill-equipped to take in high-income COVID-19 patients will nearly double its nursing staff, allow increased supervision and pay $275,000 in fines and costs to settle a lawsuit brought by the attorney’s office of the city of Los Angeles.

The city of Atty. Mike Feuer on Monday announced a formal settlement with the Lakeview Terrace skilled nursing facility, which he accused of “conduct” and “intentional” misconduct for failing to treat some patients adequately, while pushing others out of the 99-bed home.
The city alleges in its lawsuit that the area west of downtown has an incentive to evacuate longtime residents to make room for COVID-19 patients, which brought Lakeview Terrace the highest Medicare reimbursements.
“This victory for these patients is even more important given the devastating impact of COVID-19 on nursing home residents in LA and across the country,” Feuer said in announcing the rally. He predicted that the agreement would lead to “major improvements in patient care, new safety measures related to COVID [and] improved monitoring when patients are discharged.”
The city attorney’s lawsuit alleges that Lakeview Terrace failed to administer prescribed medication to terminally ill patients and falsely reported that the medication had been administered.

The July action, filed in Superior Court, also alleges that family members were not contacted when the patients were “dumped” in other areas or on the street.
In one incident, the lawsuit said, an 88-year-old man with dementia was moved from a Westlake nursing home to a Van Nuys apartment, only to be found a day later wandering the streets, very confused.
One Lakeview Terrace patient with HIV was released and decided to huddle in a friend’s backyard, hoping he would be safe there from the coronavirus, the suit argued.
“Although Lakeview disputes the underlying allegations, the costs associated with suing the City are properly placed in the care of residents,” the center’s manager, DJ Weaver, said in an email.

Feuer acknowledged that the center has cooperated with the city attorney’s office throughout the investigation. Weaver concluded: “In short, all Lakeview residents can expect the best in medical care. Residents have been, and will continue to be, the most important thing in Lakeview. “
Health care experts have warned that skilled nursing benefits paid under the federal government’s plan to care for people affected by the coronavirus will lead to patient abandonment by unscrupulous workers. The reimbursement plan pays more than four times more for COVID-19 patients than the homes would charge for long-term residents with debilitating conditions.
The lawsuit is similar to one filed in 2019 by the city attorney’s office against Lakeview Terrace. That action also accuses the home of patient abandonment, inadequate care and failure to maintain proper patient records.
The new residence restores the outdoor monitor originally placed on Lakeview Terrace following the 2019 lawsuit. Meanwhile, the monitor will have broad powers to protect residents, with 24-hour access to patient records and the ability to conduct anonymous inspections. The outside monitor will remain in place for 18 months, at the discretion of Feuer’s office.
