Are There Any Free Lawyers – In certain Long Island family court cases, a party may be entitled to an assigned attorney. This “mandated lawyer” is typically referred to as an 18b lawyer. These appointed lawyers are a vital part of the Family Court and are essential in protecting certain basic rights of parents.
Both statutory and constitutional law require New York State to provide counsel to certain individuals who are financially unable to obtain an attorney. Specifically, in Suffolk County, such assigned counsel is provided under the Suffolk County Assigned Counsel Defender Plan pursuant to County Law Article 18-B, which is where these attorneys get their nickname.

In family court cases in particular, the New York State Appeals ruled that “an indigent parent faced with the loss of a child’s community, as well as the possibility of criminal charges, is entitled to the assistance of counsel.” In re Ella B., 30 N.Y.2d 352 (1972). The court went on to emphasize the importance of parents’ right to custody and care of their children. The court stated that failure to provide a parent with an attorney would be unconstitutional. The New York State Legislature continued to codify this right in a number of family law cases. These cases range from those involving custody and visitation to abuse/neglect, termination of parental rights and family crime cases.

While in our practice we only encounter 18b lawyers in family law, 18b lawyers also handle many other types of cases. 18b Lawyers are also critical actors in criminal proceedings. They represent indigent defendants in crimes and misdemeanors, including murder cases. These lawyers can also represent defendants in appeals.
These attorneys may also be appointed in cases involving government intervention. An 18b attorney can represent parties in cases involving the state, such as child protection, foster care, and termination of parental rights cases.
Typically, the judges decide who is entitled to an 18b lawyer. In order to have an 18b lawyer appointed to you, the judge must therefore first make a decision that you are poor and cannot afford to hire a private lawyer.
Normally, to be placed on the 18b panel, the lawyer must have participated on several occasions in one of the following:

What Is The Difference Between A Lawyer And An Attorney?
When looking for accident attorneys who offer free case evaluations, it can be difficult to narrow down your options. In addition, you may not know what to ask during a free consultation.
Knowing how to go about a free consultation with a NYC attorney can help you get the most out of the meeting so you can choose the best one for your case.
Think of your consultation as a conversation where you get to know the attorney while they assess the strength of your case.
Most consultations last between 30 minutes and an hour. It can help to get as much information down as possible since your time is short.

Even if you don’t think you have a case, it’s always best to have an attorney review the facts. After knowing the circumstances surrounding the accident, the attorney will tell you whether or not you have a strong case.
If you have evidence in your case, bring that too. This could be a police report of an accident or an incident report if you were injured at a place of business, such as a slip and fall accident.
Be as honest as possible about the incident, including whether you were drinking or using drugs. Your lawyer cannot help you without all the facts. You can feel more secure if you remember that everything discussed between you and your lawyer is confidential.
Many NYC personal injury attorneys work on a contingency fee basis, meaning they take their fees out of any compensation you receive from a settlement or court decision. If your lawyer works on a contingency basis, you will not pay for their legal services unless you win your case.
How To Find The Best Nj Expungement Lawyer To Clear Your Record
Many personal injury attorneys focus on a few different areas, while others handle car accidents exclusively. Make sure your attorney has experience dealing with the type of injury and circumstances you have, as the laws for injuries can vary depending on how and where they occurred.
Many larger law firms have teams that work with clients, including paralegals. It is important to know who will handle your case and answer your questions or concerns.
Your attorney will determine the value of your damages, including the cost of medical treatment, replacement or repair of damaged property (like your car), and recovery of lost wages if you had to miss work because of the accident.
Be wary of lawyers who promise a substantial settlement or guarantee a win. While your attorney must put a dollar amount in the case papers filed with the court, it is not a guarantee of what you will actually receive.

Finally, ask if the lawyer is willing to take your case to court if necessary. The parties involved in the case will often settle out of court and negotiate the compensation. But if you can’t reach an agreement, then the case will go before a judge. Ask your lawyer how much experience they have.

Starting next year, New York will become the first state to require lawyers to do unpaid work before being licensed to practice, the state’s chief justice announced Tuesday, describing the rule as a way to help the growing number of people who can’t afford legal services.
The roughly 10,000 lawyers who apply to the New York State Bar each year must demonstrate that they have done 50 hours of pro bono work to be admitted, Chief Judge Jonathan Lippman said. He said the move was intended to provide about half a million hours of much-needed legal services to those with pressing issues, such as foreclosure and domestic violence.
The need has exploded in recent years as the economic crisis delivered what pro-poor advocates call a triple whammy: more people are struggling financially; more people need legal services to cope with foreclosures, evictions, and credit and employment problems that can push them into long-term poverty; and state and federal funding for legal services has plunged.
What It Really Means When A Lawyer Says, ‘i’m Too Busy To Take Your Case’
The Legal Aid Society, the nation’s largest provider of free legal services, turns away eight out of nine people seeking help with civil legal matters, said Steven Banks, the New York group’s chief attorney. Since the economic downturn began in 2008, Mr. Banks said, requests for assistance have increased by 40 percent for health issues, 54 percent for unemployment insurance and work-related issues, 16 percent for domestic violence and “a staggering 800 percent” for foreclosures.
While criminal defendants have a constitutional right to free legal representation, defendants in civil cases — as well as people who need legal help for essential needs like applying for disability benefits — do not.
