Are Charitable Donations 100 Deductible

This is a state tax break that was included in the CARES Act, which was passed last spring to help offset the economic hardship of Covid-19. Temporarily changed the rules on how much you can deduct from cash donations to charity.

The tax treatment of charitable donations has been impacted by two major tax events in recent years: the Tax Cuts and Jobs Act (TCJA) of 2017 and the Coronavirus Relief, Relief, and Economic Security (CARES) Act of 2020. These changes provide a case study of how changes in tax policy can affect taxpayer behavior in the short term, but also how these policies have made tax withholding a domain of the wealthy.

Despite these wild swings in tax policy, history shows that giving is more tied to higher after-tax incomes and a growing economy than to tax incentives for charitable giving.

When lawmakers drafted the TCJA, they knew that one of the goals was to lower marginal tax rates. In 2017, there were seven levels of individual income tax, ranging from 10 percent to a top marginal tax rate of 39.6 percent. In fact, TCJA cut most tax rates — including the top rate — to 37 percent.

Many taxpayers took advantage of these upcoming changes by increasing their charitable giving in 2017 in order to be able to deduct it from the higher tax rates. This was particularly the case for high-income taxpayers.

As shown in Table 1, total charitable tax deductions increased 9 percent in 2017 compared to 2016, from approximately $234 billion to $256 billion. However, charitable tax deductions increased 14 percent for taxpayers with incomes between $200,000 and $500,000, while deductions for those with incomes between $500,000 and $1 million increased 18 percent.

Meanwhile, charitable tax deductions for those earning $1 million to $10 million increased by a staggering 72 percent, or $22.5 billion. As we shall see, charitable tax deductions for these wealthy taxpayers fell significantly in 2018, suggesting that they brought deductions forward into the year with the higher tax rates.
